1. Scope
These Terms of Service apply to the iOS app HYBBIT ("App"). Deviating terms only apply if we confirm them in writing. Additionally, Apple's Standard EULA (Licensed Application End User License Agreement) applies; in case of conflicts, Apple's EULA takes precedence insofar as mandatory law does not provide otherwise.

3. Subject Matter / Scope of Functions
HYBBIT is a habit tracker. The app works without an account; data is stored locally on your device. There is no cloud synchronization. Functionality, designs, and content may be continuously developed.
4. In-App Purchases / Subscriptions (Auto-Renewal)
- You can subscribe to a Pro subscription (e.g., monthly or yearly). Price, duration, and content are displayed in the app.
- Billing is handled through your Apple ID in the App Store; Apple is the Merchant of Record.
- The subscription automatically renews unless cancelled at least 24 hours before the end of the respective term.
- Management/Cancellation: iOS Settings → [Your Name] → Subscriptions (or App Store → Account → Subscriptions).
- Refunds are subject to App Store policies; we do not receive payment data.
- Trial periods (if offered): Unused remaining time expires when a paid subscription begins.
- Price changes are communicated by Apple; you can cancel before they take effect.
5. Withdrawal
Withdrawal, refunds, and billing issues are exclusively handled through the App Store and are subject to its rules. Please use the corresponding Apple functions.
6. Usage Rights and License
We grant you a personal, non-exclusive, non-transferable license to use the app on devices associated with your Apple ID, in accordance with Apple's EULA and these terms. Modification, decompilation, or other reverse engineering is only permitted insofar as mandatory law allows.
7. User Obligations / Prohibited Use
Prohibited activities include in particular: circumventing security functions, automated extraction/scraping, distribution of malware/spam, legal violations (copyright, trademark, personality rights), and any abusive/impairing use.
8. Availability and Changes
We strive for trouble-free operation but cannot exclude outages (maintenance, security, force majeure). There is no claim to specific availability or specific functions. We may adapt, extend, restrict, or discontinue the app.
9. Liability
- We are liable without limitation for intent and gross negligence.
- For simple negligence, we are only liable for breach of essential contractual obligations (cardinal obligations) and limited in amount to foreseeable, contract-typical damages.
- Claims for injury to life, body, or health as well as under the Product Liability Act remain unaffected.
- Apple is not a party to this user relationship and is not liable for maintenance/support of the app, insofar as legally permissible.
10. Warranty
Statutory provisions apply. For free use, our warranty is limited to intent and gross negligence, insofar as legally permissible.

12. Termination of Use
You can uninstall the app at any time. Subscriptions must be cancelled separately through Apple subscriptions. In case of significant breaches of duty, we may revoke your license.
13. Consumer Dispute Resolution
We are neither obligated nor prepared to participate in dispute resolution procedures before a consumer arbitration board.
14. Choice of Law / Jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, the mandatory law of their habitual residence additionally applies. If the user is a merchant, our place of business is the place of jurisdiction.
15. Changes to These Terms
We may adapt these terms. We announce significant changes in-app and/or on the website. Continued use after they take effect constitutes acceptance.
